Les présentes Conditions Générales régissent la vente par le VENDEUR à ses CLIENTS des PRODUITS.
Le CLIENT est clairement informé et reconnaît que le SITE s’adresse aux consommateurs et que les professionnels doivent contacter le service commercial du VENDEUR afin de bénéficier de conditions contractuelles distinctes
Le CLIENT s’engage à lire attentivement les présentes Conditions Générales et les accepter, avant de procéder au paiement d’une commande de PRODUITS passée sur le SITE.
Les présentes Conditions Générales sont référencées en bas de chaque page du SITE au moyen d’un lien et doivent être consultées avant de passer la commande. Le CLIENT est invité à lire attentivement, télécharger, imprimer les Conditions Générales et à en conserver une copie.
Le VENDEUR conseille au CLIENT de lire les Conditions Générales à chaque nouvelle commande, la dernière version desdites Conditions s’appliquant à toute nouvelle commande de PRODUITS.
En cliquant sur le premier bouton pour passer la commande puis sur le second pour confirmer ladite commande, le CLIENT reconnaît avoir lu, compris et accepté les Conditions Générales sans limitation ni condition.
Pour pouvoir acheter un PRODUIT, le CLIENT doit être âgé d’au moins 18 ans et disposer de la capacité légale ou, s’il est mineur, être en mesure de justifier de l’accord de ses représentants légaux.
Le CLIENT sera invité à fournir des informations permettant de l’identifier en complétant le formulaire disponible sur le SITE. Le signe (*) indique les champs obligatoires qui doivent être remplis pour que la commande du CLIENT soit traitée par le VENDEUR. Le CLIENT peut vérifier sur le SITE le statut de sa commande. Le suivi des LIVRAISONS peut, le cas échéant, être effectué en utilisant les outils de suivi en ligne de certains transporteurs. Le CLIENT peut également contacter le service commercial du VENDEUR à tout moment par courrier électronique, à l’adresse frederic.boissie@lilleauxjouets.com, afin d’obtenir des informations sur le statut de sa commande.
Les informations que le CLIENT fournit au VENDEUR lors d’une commande doivent être complètes, exactes et à jour. Le VENDEUR se réserve le droit de demander au CLIENT de confirmer, par tout moyen approprié, son identité, son éligibilité et les informations communiquées.
Article 5.1 Caractéristique des produits
Le VENDEUR s’engage à présenter les caractéristiques essentielles des PRODUITS (sur les fiches d’information disponibles sur le SITE) et les informations obligatoires que le CLIENT doit recevoir en vertu du droit applicable (dans les présentes Conditions Générales).
Le CLIENT s’engage à lire attentivement ces informations avant de passer une commande sur le SITE.
Sauf indication expresse contraire sur le SITE, tous les PRODUITS vendus par le VENDEUR sont neufs et conformes à la législation européenne en vigueur et aux normes applicables en France.
Article 5.2. Procédure de commande
Les commandes de PRODUITS sont directement passées sur le SITE. Pour effectuer une commande, le CLIENT doit suivre les étapes décrites ci-dessous (veuillez noter cependant qu’en fonction de la page de démarrage du CLIENT, les étapes peuvent légèrement différer).
5.2.1. Sélection des PRODUITS et options d’achat
Le CLIENT devra sélectionner le(s) PRODUIT(s) de son choix en cliquant sur le(s) PRODUIT(s) concerné(s) et en choisissant les caractéristiques et les quantités souhaitées. Une fois le PRODUIT sélectionné, le PRODUIT est placé dans le panier du CLIENT. Ce dernier peut ensuite ajouter à son panier autant de PRODUITS qu’il le souhaite.
5.2.2. Commandes
Une fois les PRODUITS sélectionnés et placés dans son panier, le CLIENT doit cliquer sur le panier et vérifier que le contenu de sa commande est correct. Si le CLIENT ne l’a pas encore fait, il sera ensuite invité à s’identifier ou à s’inscrire.
Une fois que le CLIENT aura validé le contenu du panier et qu’il se sera identifié / inscrit, s’affichera à son attention un formulaire en ligne complété automatiquement et récapitulant le prix, les taxes applicables et, le cas échéant, les frais de livraison.
Le CLIENT est invité à vérifier le contenu de sa commande (y compris la quantité, les caractéristiques et les références des PRODUITS commandés, l’adresse de facturation, le moyen de paiement et le prix) avant de valider son contenu.
Le CLIENT peut alors procéder au paiement des PRODUITS en suivant les instructions figurant sur le SITE et fournir toutes les informations nécessaires à la facturation et à la LIVRAISON des PRODUITS. Concernant les PRODUITS pour lesquels des options sont disponibles, ces références spécifiques apparaissent lorsque les bonnes options ont été sélectionnées. Les commandes passées doivent comprendre toutes les informations nécessaires au bon traitement de la commande.
Le CLIENT doit également sélectionner le mode de livraison choisi.
5.2.3. Accusé de réception
Une fois que toutes les étapes décrites ci-dessus sont complétées, une page apparait sur le SITE afin d’accuser réception de la commande du CLIENT. Une copie de l’accusé de réception de la commande est automatiquement adressée au CLIENT par courrier électronique, à condition que l’adresse électronique communiquée par le biais du formulaire d’inscription soit correcte. .
Le VENDEUR n’envoie aucune confirmation de commande par courrier postal ou par télécopie.
5.2.4. Facturation
Pendant la procédure de commande, le CLIENT devra saisir les informations nécessaires à la facturation (le signe (*) indiquera les champs obligatoires devant être remplis pour que la commande du CLIENT soit traitée par le VENDEUR).
Le CLIENT doit notamment indiquer clairement toutes les informations relatives à la LIVRAISON, en particulier l’adresse exacte de LIVRAISON, ainsi que tout éventuel code d’accès à l’adresse de LIVRAISON.
Le CLIENT devra ensuite préciser le moyen de paiement choisi.
Ni le bon de commande que le CLIENT établit en ligne, ni l’accusé de réception de la commande que le VENDEUR envoie au CLIENT par courrier électronique ne constituent une facture. Quel que soit le mode de commande ou de paiement utilisé, Le CLIENT recevra l’original de la facture à la LIVRAISON des PRODUITS, à l’intérieur du colis.
5.3. Date de la commande
La date de la commande est la date à laquelle le VENDEUR accuse réception en ligne de la commande. Les délais indiqués sur le SITE ne commencent à courir qu’à partir de cette date.
5.4. Prix
Pour tous les PRODUITS, le CLIENT trouvera sur le SITE des prix affichés en euros toutes taxes comprises, ainsi que les frais de livraison applicables (en fonction du poids du colis, hors emballage et cadeaux, de l’adresse de LIVRAISON et du transporteur ou mode de transport choisi).
Les prix incluent en particulier la taxe sur la valeur ajoutée (TVA) au taux en vigueur à la date de commande. Toute modification du taux applicable peut impacter le prix des PRODUITS à compter de la date d’entrée en vigueur du nouveau taux.
Le taux de TVA applicable est exprimé en pourcentage de la valeur du PRODUIT vendu.
Les prix des fournisseurs du VENDEUR sont susceptibles d’être modifiés. En conséquence, les prix indiqués sur le SITE peuvent changer. Ils peuvent également être modifiés en cas d’offres ou de ventes spéciales.
Les prix indiqués sont valables, sauf erreur grossière. Le prix applicable est celui indiqué sur le SITE à la date à laquelle la commande est passée par le CLIENT.
5.5. Disponibilité des PRODUITS
L’indisponibilité d’un PRODUIT est en principe indiquée sur la page du PRODUIT concerné. Les CLIENTS peuvent également être informés du réassort d’un PRODUIT par le VENDEUR.
En tout état de cause, si l’indisponibilité n’a pas été indiquée au moment de la commande, le VENDEUR s’engage à informer le CLIENT sans délai si le PRODUIT est indisponible.
Le VENDEUR peut, à la demande du CLIENT :
Soit proposer d’expédier tous les PRODUITS en même temps dès que les PRODUITS en rupture de stock seront à nouveau disponibles,
Soit procéder à une expédition partielle des PRODUITS disponibles dans un premier temps, puis à l’expédition du reste de la commande lorsque les autres PRODUITS seront disponibles, sous réserve d’une information claire concernant les frais de transport supplémentaires qui pourront être engagés,
Soit proposer un PRODUIT alternatif de qualité et de prix équivalents, accepté par le CLIENT.
Si le CLIENT décide d’annuler sa commande de PRODUITS indisponibles, il obtiendra le remboursement de toutes les sommes versées pour les PRODUITS indisponible au plus tard dans les trente (30) jours du paiement.
Les modalités du droit de rétractation sont prévues dans la section « Modalités d’exercice du droit de rétractation », disponible en Annexe 1 des présentes et accessible en bas de chaque page du SITE via un lien hypertexte.
Tout contrat conclu avec le CLIENT correspondant à une commande d’un montant supérieur à 120 euros TTC sera archivé par le VENDEUR pendant une durée de dix (10) ans conformément à l’article L. 134-2 du code de la consommation.
Le VENDEUR accepte d’archiver ces informations afin d’assurer un suivi des transactions et de produire une copie du contrat à la demande du CLIENT.
En cas de litige, le VENDEUR aura la possibilité de prouver que son système de suivi électronique est fiable et qu’il garantit l’intégrité de la transaction.
Le VENDEUR reste le propriétaire des PRODUITS livrés jusqu’à leur complet paiement par le CLIENT.
Les dispositions ci-dessus ne font pas obstacle au transfert au CLIENT, au moment de la réception par lui, ou par un tiers désigné par lui autre que le transporteur, des risques de perte ou de dommage des PRODUITS faisant l’objet de la réserve de propriété, ainsi que des risques de dommage qu’ils pourront entraîner.
Les modalités de LIVRAISON des PRODUITS sont prévues dans la « politique de livraison » visée en Annexe 2 des présentes et accessibles en bas de chaque page du SITE via un lien hypertexte.
Les PRODUITS seront emballés conformément aux normes de transport en vigueur, afin de garantir un maximum de protection pour les PRODUITS pendant la LIVRAISON. Les CLIENTS s’engagent à respecter les mêmes normes lorsqu’ils retournent des PRODUITS dans les conditions fixées en Annexe 1 – modalités d’exercice du droit de rétractation.
Le VENDEUR met à la disposition du CLIENT un « Service téléphonique Client » au numéro suivant : 06.10.75.58.93 (numéro non surtaxé).
Toute réclamation écrite du CLIENT devra être transmise à l’adresse suivante : 68 rue Jules Guesde.
Tous les éléments visuels et sonores du SITE, y compris la technologie sous-jacente utilisée, sont protégés par le droit d’auteur, le droit des marques et/ou des brevets.
Ces éléments sont la propriété exclusive du VENDEUR. Toute personne qui édite un site web et souhaite créer un lien hypertexte direct vers le SITE doit demander l’autorisation du VENDEUR par écrit.
Cette autorisation du VENDEUR ne sera en aucun cas accordée de manière définitive. Ce lien devra être supprimé à la demande du VENDEUR. Les liens hypertextes vers le SITE qui utilisent des techniques tels que le cadrage (framing) ou l’insertion par liens hypertextes (in-line linking) sont strictement interdits.
Toute modification de la législation ou de la réglementation en vigueur, ou toute décision d’un tribunal compétent invalidant une ou plusieurs clauses des présentes Conditions Générales ne saurait affecter la validité des présentes Conditions Générales. Une telle modification ou décision n’autorise en aucun cas les CLIENTS à méconnaître les présentes Conditions Générales.
Toutes conditions non expressément traitées dans les présentes seront régies conformément à l’usage du secteur du commerce aux particuliers, pour les sociétés dont le siège social se situe en France.
Les présentes Conditions Générales s’appliquent à tous les achats effectués en ligne sur le SITE, tant que le SITE est disponible en ligne.
Les Conditions Générales sont datées de manière précise et pourront être modifiées et mises à jour par le VENDEUR à tout moment. Les Conditions Générales applicables sont celles en vigueur au moment de la commande.
Les modifications apportées aux Conditions Générales ne s’appliqueront pas aux PRODUITS déjà achetés.
Les présentes Conditions Générales ainsi que les relations entre le CLIENT et le VENDEUR sont régies par le droit français.
En cas de litige, seuls les tribunaux français seront compétents.
Toutefois, préalablement à tout recours au juge arbitral ou étatique, sera privilégiée la négociation dans un esprit de loyauté et de bonne foi en vue de parvenir à un accord amiable lors de la survenance de tout conflit relatif au présent contrat, y compris portant sur sa validité.
La partie souhaitant mettre en oeuvre le processus de négociation devra en informer l’autre partie par lettre recommandée avec accusé de réception en indiquant les éléments du conflit. Si au terme d’un délai de quinze (15) jours, les parties ne parvenaient pas à s’entendre, le différend sera soumis à la juridiction compétente désignée ci-après.
Durant tout le processus de négociation et jusqu’à son issue, les parties s’interdisent d’exercer toute action en justice l’une contre l’autre et pour le conflit objet de la négociation. Par exception, les parties sont autorisées à saisir la juridiction des référés ou à solliciter le prononcé d’une ordonnance sur requête. Une éventuelle action devant la juridiction des référés ou la mise en oeuvre d’une procédure sur requête n’entraîne de la part des parties aucune renonciation à la clause d’arrangement amiable, sauf volonté contraire expresse.

1.1
Basic Account Information
You don’t have to create an account to use some of our service features, such as searching and viewing public LilleAuxJouets profiles or watching a broadcast on Periscope’s website. If you do choose to create an account, you must provide us with some personal data so that we can provide our services to you. On LilleAuxJouets this includes a display name (for example, “LilleAuxJouets Moments”), a username (for example, @LilleAuxJouetsMoments), a password, and an email address or phone number. Your display name and username are always public, but you can use either your real name or a pseudonym. If you choose to create a professional account, you must also provide us with your professional category, and may provide us with additional information, including street address, contact email address, and contact phone number, all of which will always be public. You can also create and manage multiple LilleAuxJouets accounts1, for example to express different parts of your identity.

Public Information
Most activity on LilleAuxJouets is public, including your profile information2, your display language, when you created your account, and your Tweets and certain information about your Tweets like the date, time, and application and version of LilleAuxJouets you Tweeted from. You also may choose to publish your location in your Tweets or your LilleAuxJouets profile. When you share audio or visual content on our service we may analyze that data to operate our services, for example by providing audio transcription. The lists you create, people you follow and who follow you, and Tweets you Like or Retweet are also public. If you like, Retweet, reply, or otherwise publicly engage with an ad on our services, that advertiser might thereby learn information about you associated with the ad with which you engaged such as characteristics of the audience the ad was intended to reach. Broadcasts (including LilleAuxJouets Spaces) you create are public along with when you created them. Your engagement with broadcasts, including viewing, listening, commenting, speaking, reacting to, or otherwise participating in them, either on Periscope (subject to your settings) or on LilleAuxJouets, is public along with when you took those actions. On Periscope, so are your hearts, comments, the number of hearts you’ve received, which accounts you are a Superfan of, and whether you watched a broadcast live or on replay. Any engagement with another account’s broadcast will remain part of that broadcast for as long as it remains on our services. Information posted about you by other people who use our services may also be public. For example, other people may tag you in a photo3 (if your settings allow) or mention you in a Tweet.
You are responsible for your Tweets and other information you provide through our services, and you should think carefully about what you make public, especially if it is sensitive information. If you update your public information on LilleAuxJouets, such as by deleting a Tweet or deactivating your account, we will reflect your updated content on LilleAuxJouets.com, LilleAuxJouets for iOS, and LilleAuxJouets for Android.
By publicly posting content, you are directing us to disclose that information as broadly as possible, including through our APIs, and directing those accessing the information through our APIs to do the same. To facilitate the fast global dissemination of Tweets to people around the world, we use technology like application programming interfaces (APIs) and embeds to make that information available to websites, apps, and others for their use - for example, displaying Tweets on a news website or analyzing what people say on LilleAuxJouets. We generally make this content available in limited quantities for free and charge licensing fees for large-scale access. We have standard terms that govern how this data can be used, and a compliance program to enforce these terms. But these individuals and companies are not affiliated with LilleAuxJouets, and their offerings may not reflect updates you make on LilleAuxJouets. Contact Information and Address Books
We use your contact information, such as your email address or phone number, to authenticate your account and keep it - and our services - secure, and to help prevent spam, fraud, and abuse. Subject to your settings, we also use contact information to enable certain account features (for example, for login verification), to send you information about our services, and to personalize our services, including ads. If you provide us with your phone number, you agree to receive text messages from LilleAuxJouets to that number as your country’s laws allow. LilleAuxJouets also uses your contact information to market to you as your country’s laws allow, and to help others find your account if your settings permit, including through third-party services and client applications. You can use your settings for email and mobile notifications to control notifications you receive from LilleAuxJouets. You can also unsubscribe from a notification by following the instructions contained within the notification or here.
You can choose to upload and sync your address book on LilleAuxJouets so that we can help you find and connect with people you know and help others find and connect with you. We also use this information to better recommend content to you and others.
You can sign up for Periscope with an account from another service like LilleAuxJouets, Google, or Facebook, or connect your Periscope account to these other services. If you do, we will use information from that service, including your email address, friends, or contacts list, to recommend other accounts or content to you or to recommend your account or content to others. You can control whether your Periscope account is discoverable by email through your Periscope settings.
If you email us, we will keep the content of your message, your email address, and your contact information to respond to your request.
1.4
Direct Messages and Non-Public Communications
We provide certain features that let you communicate more privately or control who sees your content. For example, you can use Direct Messages to have non-public conversations on LilleAuxJouets, protect your Tweets, or host private broadcasts on Periscope. When you communicate with others by sending or receiving Direct Messages, we will store and process your communications and information related to them. This includes link scanning for malicious content, link shortening to http://t.co URLs, detection of spam4, abuse and prohibited images, and use of reported issues. We also use information about whom you have communicated with and when (but not the content of those communications) to better understand the use of our services, to protect the safety and integrity of our platform, and to show more relevant content. We share the content of your Direct Messages with the people you’ve sent them to; we do not use them to serve you ads. Note that if you interact in a way that would ordinarily be public with LilleAuxJouets content shared with you via Direct Message, for instance by liking a Tweet, those interactions will be public. When you use features like Direct Messages to communicate, remember that recipients have their own copy5 of your communications on LilleAuxJouets - even if you delete your copy of those messages from your account - which they may duplicate, store, or re-share.

Payment Information
You may provide us with payment information6, including your credit or debit card number, card expiration date, CVV code, and billing address, in order to purchase advertising or other offerings provided as part of our services. If you make a payment or send money using LilleAuxJouets features or services, including through an intermediary, we may receive information about your transaction such as when it was made or when a subscription is set to expire or auto-renew.

• Whether your Tweets are publicly available on LilleAuxJouets
• Whether others can tag you in a photo

• Whether you upload your address book to LilleAuxJouets for storage and use
• When and where you may see sensitive content on LilleAuxJouets
• Whether you want to block or mute other LilleAuxJouets accounts

Location Information
We require information about your signup and current location, which we get from signals such as your IP address or device settings, to securely and reliably set up and maintain your account and to provide our services to you.
Subject to your settings, we may collect, use, and store additional information about your location - such as your current precise position or places where you’ve previously used LilleAuxJouets - to operate or personalize our services including with more relevant content like local trends, stories, ads, and suggestions for people to follow. Links
In order to operate our services, we keep track of how you interact with links across our services. This includes links in emails we send you and links in Tweets that appear on other websites or mobile applications.
If you click on an external link or ad on our services, that advertiser or website operator might figure out that you came from LilleAuxJouets or Periscope, along with other information associated with the ad you clicked such as characteristics of the audience it was intended to reach. They may also collect other personal data from you, such as cookie identifiers or your IP address.

Cookies
A cookie is a small piece of data that is stored on your computer or mobile device. Like many websites, we use cookies and similar technologies to collect additional website usage data and to operate our services. Cookies are not required for many parts of our services such as searching and looking at public profiles. Log Data
We receive information when you view content on or otherwise interact with our services, which we refer to as “Log Data,” even if you have not created an account. For example, when you visit our websites, sign into our services, interact with our email notifications, use your account to authenticate to a third-party service, or visit a third-party service that includes LilleAuxJouets content, we may receive information about you. This Log Data includes information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms (including those not submitted as queries), and cookie information. We also receive Log Data when you click on, view, or interact with links on our services, including when you install another application through LilleAuxJouets. LilleAuxJouets for Web Data
When you view our content on third-party websites that integrate LilleAuxJouets content such as embedded timelines or Tweet buttons, we may receive Log Data that includes the web page you visited. We use this information to better understand the use of our services, to protect the safety and integrity of our platform, and to show more relevant content, including ads. We do not associate this web browsing history with your name, email address, phone number, or username, and we delete, obfuscate, or aggregate it after no longer than 30 days. We do not collect this data from browsers that we believe to be located in the European Union, the United Kingdom, or EFTA States.

Advertisers and Other Ad Partners
Advertising revenue allows us to support and improve our services. You may choose to connect your LilleAuxJouets account to accounts on another service, and that other service may send us information about your account on that service. We use the information we receive to provide you features like cross-posting or cross-service authentication, and to operate our services. For integrations that LilleAuxJouets formally supports, you may revoke this permission at any time from your application settings; for other integrations, please visit the other service you have connected to LilleAuxJouets.

Personalizing Based On Your Inferred Identity
When you log into LilleAuxJouets on a browser or device, we will associate that browser or device with your account for purposes such as authentication, security, and personalization. Subject to your settings, we may also associate your account with browsers or devices other than those you use to log into LilleAuxJouets (or associate your logged-out device or browser with other browsers or devices). When you provide other information to LilleAuxJouets, including an email address, we associate that information with your LilleAuxJouets account. Sharing You Control
We share or disclose your personal data with your consent or at your direction, such as when you authorize a third-party web client or application to access your account or when you direct us to share your feedback with a business. Similarly, to improve your experience, we work with third-party partners to display their video content on LilleAuxJouets. When you watch or otherwise interact with content from these partners, they may receive and process your personal data as described in their privacy policies. If you do not want this content to play automatically, you can adjust your autoplay settings. If you’ve shared information like Direct Messages or protected Tweets with someone else who accesses LilleAuxJouets through a third-party service, keep in mind that the information may be shared with the third-party service.
Subject to your settings, we also provide certain third parties with personal data to help us offer or operate our services. Accessing or Rectifying Your Personal Data
If you have registered an account on LilleAuxJouets, we provide you with tools and account settings to access, correct, delete, or modify the personal data you provided to us and associated with your account. You can download certain account information, including your Tweets, by following the instructions here. On Periscope, you can request correction, deletion, or modification of your personal data, and download your account information, by following the instructions here. We may require you to provide additional information for verification.
4.2
Deletion
We keep Log Data for a maximum of 18 months. If you follow the instructions here (or for Periscope here), your account will be deactivated. When deactivated, your LilleAuxJouets account, including your display name, username, and public profile, will no longer be viewable on LilleAuxJouets.com, LilleAuxJouets for iOS, and LilleAuxJouets for Android. For up to 30 days after deactivation it is still possible to restore your LilleAuxJouets account if it was accidentally or wrongfully deactivated.
Keep in mind that search engines and other third parties may still retain copies of your public information, like your profile information and public Tweets, even after you have deleted the information from our services or deactivated your account. Learn more here.
